The Basic Statute of Public Employees (EBEP) outlines the rights and duties of public administration workers, including paid personal leave days popularly known as 'moscosos'. These paid permits allow employees to be absent from work without needing to justify the reason, provided service needs and internal planning are respected.
Generally, public employees in Spain are entitled to six days of personal leave per year, according to Article 48 of the EBEP. However, in 2026, this number will increase by one day.
The reason for this increase lies in the 2026 work calendar. August 15th, a non-recoverable and non-substitutable national holiday, will fall on a Saturday. The EBEP provides for the recovery of such holidays as an additional day of personal leave to compensate the employee.
This measure is formalized in the Resolution of the State Secretariat for Public Function, which regulates the enjoyment of this additional leave day for 2026 as a consequence of the national holiday coinciding with a Saturday.
