The Contentious-Administrative Chamber of the TSJM has admitted for processing the lawsuit filed by the Ayuntamiento de Gáldar against the resolution of the Directorate General of European Funds of the Ministry of Finance and Public Administrations. This resolution excluded the municipality from the allocation of 15 million euros in FEDER funds from the European Union.
The court has suspended the deadline for the final formulation of the lawsuit, considering that the Ministry should have provided the City Council with access to the valuation records of the submitted projects during the administrative process. It is now required to submit this complete file to the judicial body within 20 days.
This marks a significant first step for the Ayuntamiento de Gáldar in its legal dispute with the Spanish Government over the exclusion from the EDIL call for FEDER funds. Until now, the Ministry had not made public the valuation records of all projects, despite the allegations and appeals filed by the council.
The TSJM sides with Gáldar regarding the Directorate General of European Funds' obligation to complete the administrative file. Lawyer Javier Navarro, an expert in these procedures, represents the council. The suspension of the deadline for the lawsuit will allow it to be filed with full knowledge of the evaluation conducted by each member of the project's assessment committee.
First Deputy Mayor, Julio Mateo Castillo, explained that Gáldar had insisted that "there is no record of the technical evaluation that excluded us," and the Court agrees with this requirement, obliging the Directorate General of European Funds to provide it.
Gáldar has managed nearly 20 million euros in European funds in recent years. The FEDER – EDIL funds call, submitted last year, represented 15 million euros, leading the Council to pursue legal action to clarify project evaluations and fight for the allocation of these funds.
