The political group Nueva Canarias-Bloque Canarista (NC-BC) has submitted a formal letter to the Mogán City Council. This document demands full transparency and clear justifications from the municipal government after a recent judicial decision confirmed the illegal status of 37 properties located in the Monte Carrera urbanization.
These 37 homes are the same ones that the company Carrera Ground Floor is attempting to regularize through an urban development project. This plan involves the cession of certain land to the City Council in exchange for an increase in the buildability of the complex.
“"One of the most serious issues is that the process has been allowed to continue despite the developer failing to provide proof of ownership for the plot, even after being explicitly requested to do so by the municipal administration itself."
Councillor Juan Manuel Gabella, in the letter registered last Friday, criticized the local government for proceeding with the processing of this legalization project. His criticism focuses on the fact that the promoting company has not demonstrated ownership of the land it intends to transfer, a fundamental requirement.
The document submitted by Gabella, addressed to the mayor, the municipal secretary, and legal counsel, highlights several observations made by the municipal architect in the expediente reports. These observations refer to Carrera Ground Floor's project to regularize the 37 homes and three basement premises.
NC has requested a legal report clarifying the implications of the recent ruling on the Carrera Ground Floor project. It also seeks an explanation as to why the expediente was allowed to proceed without the developer proving land ownership, and a copy of the notarial deed from July 29, 2019, which formalized the change of use from premises to housing without the required municipal authorization, along with the corresponding certificate of antiquity.
Nueva Canarias emphasizes that this action not only aims to determine potential political and administrative responsibilities but also to ensure transparency in municipal management and the legal certainty of affected residents.
