Partial Halt to Cuna del Alma Works in Adeje

An Arona judge has provisionally suspended the construction of a restaurant, swimming pool, and buggy parking in the coastal protection zone of the controversial tourism project.

Justice has ordered the provisional halt of a portion of the Cuna del Alma tourism project works in Puertito de Adeje, Tenerife, following a request from the Prosecutor's Office.

The magistrate of the first investigating court of Arona has ruled the suspension of facilities that the developer was erecting in the coastal protection easement zone. This strip, extending one hundred meters inland from the seashore, is where a restaurant, an outdoor swimming pool, and a buggy parking area, among other structures, were being built.
These constructions are part of the 420 luxury villa urbanization planned for this area, which is surrounded by protected natural spaces and sites of geological interest. The judicial resolution instructs Seprona to seal off the area and document the affected zone with a photographic report.

A restaurant, an outdoor swimming pool, or a buggy parking area can be located elsewhere outside the easement zone because they do not provide a necessary or convenient service for the use of the public maritime-terrestrial domain, even less so in a stretch of natural beach where there is no urban core.

The current suspension only affects 5.25% of plot T2 of Cuna del Alma, which covers 45,000 square meters, although the entire plan spans 430,000 m². The protection easement zone is a coastal area with highly restricted uses under the Coastal Law, intended for public pedestrian passage and the circulation of surveillance and rescue vehicles.
The Prosecutor's Office had argued that the suspended facilities do not meet the legal requirements for location in this strip, as they are not essential services for the use of the public maritime-terrestrial domain. This judicial decision comes after the magistrate upheld an appeal from the Public Ministry earlier this year, reversing an initial dismissal of the criminal case.
The popular accusation, represented by the Puertito Libre Cultural Social Ecologist Association, has unsuccessfully attempted to extend the halt to the entire project. Their initial complaint targets the entire urbanization for alleged crimes against land management and the environment, document forgery, and malfeasance in the processing of the initiative.
