The auditing body's decision concludes the case linked to the company RR7, to which the Canarian Health Service (SCS) paid nearly four million euros in 2020 for a batch of masks that never reached Canarian hospitals. This closure comes after two years without any allegations being filed, as stipulated by article 237 of the Civil Procedure Law.
In December 2023, the Court of Auditors had already provisionally archived the procedure. The instructor concluded that the facts did not generate accounting liability, as the SCS itself had activated mechanisms to try and recover the amounts paid. The resolution supports the SCS's actions during a period of extreme complexity.
Among those implicated in the 'mask case' were the former director of the SCS, Conrado Domínguez, and the former general director of Economic Resources of the SCS, Ana María Pérez Afonso, for alleged administrative malfeasance. Also involved was the sole administrator of RR7, Rayco González, for alleged aggravated fraud and money laundering.
Despite the closure in the accounting jurisdiction, the criminal investigation of the case remains open under the direction of the European Public Prosecutor's Office, which is investigating possible crimes related to the operation and the destination of the funds. Although the Canarian Government has not recovered the money, seizures have been made from those involved in the alleged fraud.
