The Civil Guard report, submitted to the judge investigating the Valka case, suggests that Setién, after leaving his position in March 2023, maintained a 'parallel function' by consulting and disseminating confidential documents to third parties for 'private interest'. He is under investigation for alleged crimes of revelation of secrets, embezzlement of public funds, administrative prevarication, influence peddling, and document forgery.
The investigation indicates that Setién used a computer installed in his home, remotely connected to municipal offices via a VPN, to access files and confidential documents using the credentials of the former manager, Marina Más. The report highlights that, despite being retired, he continued to issue instructions and provide data, suggesting that the businessmen consulted might be 'beneficiaries of the information or necessary collaborators'.
The document details several accesses and communications. On July 17, 2023, Setién consulted a report on the AD-16 Development Action and shared it with an architect identified as ‘Carlos Ardanaz’, along with information on the construction of a housing block and technical criteria. Subsequently, on August 29, he communicated with a council employee, ‘Elba’, about a 'serious administrative anomaly' in the restoration project for the bell tower of the Los Dolores church.
The inquiries also reveal conversations about budget management and invoices related to Felipe Guerra, an investigated businessman, on November 23, 2023. Furthermore, on August 30, Setién acted as a 'shadow technical advisor' for a businessman, Antonio Piñeiro, informing him about the status of a property and a desistment resolution. The remodeling of the Multiple Services Building I, with a budget of 29.6 million euros, is also among the projects of 'greatest economic relevance' in which he intervened.
Other cases include providing information on residential use regulations on rustic land to an architect, ‘Rafa Miranda’, for projects in Tamaraceite; sending information about a property belonging to Felipe Guerra; and consulting urban planning background for the 'Aldi project' of the supermarket chain. The alleged replication of documentary support for a gas station and the exchange of information on plots in Llanos de Guinea are also under investigation.
Finally, on June 14, 2023, Setién accessed information regarding a building permit application in Pozo El Drago, in the Tamaraceite ravine. On December 29, the former mayor and councilor of the Cabildo, Augusto Hidalgo, sought advice on the Infecar fairgrounds, for which Setién extracted and sent documents to the island vice-president.
