The new regulation modifies the active publicity framework for public corporations in the Canary Islands. Law 3/2026, of June 16, on island councils, replaces the specific catalogue of obligations from the previous Law 8/2015 with the general regime established in Law 12/2014, on transparency and access to public information.
This regulatory unification also affects Canarian municipalities and their dependent entities, whose obligation maps are modified. Consequently, 15 obligations previously specific to island councils now become voluntary transparency recommendations, while 18 new obligations from the Autonomous Community's general transparency regime are incorporated, increasing the total by three.
Municipalities also acquire 20 new obligations, two more than before, as 18 previously mandatory obligations become voluntary transparency recommendations. Key novelties include the mandatory publication of agreements with unions and business organizations, personnel hiring lists, travel expenses and allowances for public officials and management staff, legislative programs, service charters, advertising campaign contracts and their media plans, inventory of assets and rights, contract extensions and modifications, publication and registration of agreements and their addenda, detailed mandates for own-resource assignments, subsidies granted without public competition, complete documentation of territorial planning instruments, statistical information of interest to the Autonomous Community, and the publication of the most frequently requested information through the exercise of the right of access.
To facilitate adaptation to the new legal framework, the Commissioner has sent updated lists of active publicity obligations, effective from June 30, 2026, to the councils and municipalities. Furthermore, the Commissioner reminds island councils of the importance of properly exercising their competence in creating and maintaining the insular transparency portal, as stipulated in Article 94 of Law 3/2026, promoting necessary actions to ensure compliance with active publicity obligations by all entities within their public sector.
Through this initiative, the Canary Islands Transparency Commissioner continues to provide support and advice to Canarian public administrations to foster a homogeneous application of regulations and reinforce institutional transparency at the island level.
