The Administrative Court has issued a first-instance judgment supporting the council's position, confirming that the plot where the desalination and water purification facilities are located is municipal property. This decision dismisses the appeal filed by the bankruptcy administrator of a private company, which had challenged the public ownership of these lands.
The local corporation has consistently argued that these lands should be designated for public use, as they are intended for essential urban services such as water supply and purification. The ruling validates the municipal thesis that it is a plot of mandatory and free transfer, directly linked to basic technical infrastructures serving the urban area of Las Salinas.
“"This resolution is magnificent news for the municipality and represents an important victory within the urbanization reception process."
This judicial pronouncement adds to other favorable milestones for the Antigua Town Council in the prolonged conflict over the reception of the urbanization. In November, the council had already reported another favorable first-instance ruling and an opinion from the Canary Islands Consultative Council that also supported the public ownership of the plot. Furthermore, a bankruptcy incident had been promoted to request the exclusion of the plot from a bankruptcy proceeding and the precautionary suspension of its auction.
The current ruling recognizes the municipal ownership of both the plot and the assets integrated into the public domain, which are directly linked to the essential public service of water management.
