Santa Lucía de Tirajana's 2022 RPT Annulled Due to Irregularities

Justice has declared the modification of the Santa Lucía de Tirajana City Council's Job List null and void, compelling the council to cover legal costs.

The Justice system has declared null and void the modification of the Job List (RPT) approved in October 2022 by the Santa Lucía de Tirajana City Council, following a judicial process that concluded with two favorable rulings for the Sepca union.

The judicial decision, ratified by the High Court of Justice of the Canary Islands, confirms the first instance ruling and orders the council to bear the legal costs of the process. The annulment is due to various irregularities identified in the processing of the RPT.
According to the Sepca union, which initiated the claim, the RPT modification was carried out without proper negotiation with union organizations. This modification included significant changes, such as the creation of over 200 job positions and the alteration of qualification requirements for accessing certain positions.

One of the key points of contention was the validity of the report-proposals that supported the RPT modification. These reports were issued by an official whose appointment had previously been declared null by a final court ruling before October 2022. The High Court of Justice determined that the City Council's action in allowing this official to continue leading the human resources service and issue these reports, rendered the RPT modification null and void.
Another controversial aspect was the modification of access criteria for General Administration Technician (TAG) positions, which allowed individuals who previously did not meet the established legal requirements to participate. This change led to the urgent call for five positions, one of which was filled by an interim official who was subsequently appointed head of Human Resources.

The Sepca union has also reported that the City Council published in the Official Gazette of the Province that the 2022 modification was provisional, when in fact it had already been definitively approved. This action, according to the union, could have misled affected personnel and limited the submission of legal appeals.
