The complaint, filed by the Salvar Chira Soria y Barranco de Arguineguín Citizen Platform, targets various administrations and companies, including the Cabildo de Gran Canaria, the Insular Water Council, Red Eléctrica de España, and the General Directorate of Energy of the Canary Islands Government. They are accused of allegedly committing four crimes related to the non-compliance with emergency regulations during the meteorological event.
According to the group, these alleged anomalies led to the isolation of approximately 3,000 people and endangered the lives of some, who had to be rescued from the violent runoff that flowed down the channel bordering the municipalities of Mogán and San Bartolomé de Tirajana.
“"The administrations and companies responsible for executing the Salto de Chira hydroelectric plant did not comply with the determinations of the project's own Environmental Impact Statement (DIA) nor did they implement the Dam Emergency Plan, which is mandatory under Royal Decree 264/2021."
The platform also argues that, as a consequence of the works, the Soria dam's spillway was opened, preventing the containment of rainwater. This, they claim, substantially increased the flows down the ravine, causing floods on roads and nearby areas that isolated residents. Additionally, spills and floods in the hydraulic circuit and infrastructure tunnels are reported, with the evacuation of sludge and other materials that “allegedly ended up in the public domain and the protected maritime area.”
Among the alleged crimes are catastrophic risk due to gross negligence, a crime against natural resources and the environment for the spills, administrative malfeasance by omission due to non-compliance with legal duties of prevention and alert, and omission of the duty to render aid or professional negligence due to the lack of alert activation and disregard for population risks.
As evidence, the platform has provided copies of news from local media, graphic and video material, a Copernicus satellite image from March 20, 2026 showing the mud plume in the sea, the minutes of a meeting between the involved administrations and residents on April 9, 2026, and a list of witnesses.
