The trial will take place in the First Chamber of the Provincial Court of Las Palmas against the German citizen, identified as M.S., who allegedly committed the acts in a residence in Maspalomas. The prosecution is seeking a 10-year prison sentence for the accused.
According to the indictment, the victim had invited the accused to spend a few days at her home. During the night before the events, both shared leisure time at an establishment in the Sandía Shopping Center, where the woman consumed several alcoholic beverages. Upon returning to the residence, the victim retired to her bedroom due to feeling unwell from alcohol consumption.
The public prosecution maintains that, once the woman fell asleep and was unable to react, the accused entered the room and performed sexual acts. The Public Ministry asserts that the man acted with full knowledge that the victim could not give valid consent or oppose what was happening.

The man, who has no prior criminal record, faces a charge of sexual assault. In addition to the prison sentence, prosecutors are requesting a restraining order preventing the accused from approaching the victim within 500 meters for 12 years, as well as a prohibition from communicating with her by any means for the same period. Supervised release for ten years after serving the sentence and disqualification from professions or trades involving regular contact with minors for 12 years are also sought.
Regarding civil liability, the Public Ministry requests that the accused compensate the victim with 10,000 euros for the moral damages suffered as a consequence of the alleged acts.
