TSJC Confirms Environmental Impact Statement for Tenerife Motor Circuit Has Expired

The ruling dismisses the Cabildo's appeal and upholds the project's nullity due to non-compliance with deadlines.

The High Court of Justice of the Canary Islands (TSJC) has confirmed the expiration of the Environmental Impact Statement (EIS) for the Tenerife Motor Circuit, rejecting an appeal from the Cabildo.

The Administrative Litigation Chamber of the TSJC has ruled against the appeal filed by the Cabildo, confirming that the EIS for one of the four projects of the Tenerife Motor Circuit has expired. This complex, which is planned to occupy 650,000 square meters in Granadilla, has an initial public investment of 51 million euros.
The judicial decision supports the Tenerife Association of Friends of Nature (ATAN), which had raised concerns about the situation. The ruling declares the nullity of the Project for Earthworks and Removable Grandstand Installations for the Circuit, concluding that the works were not genuinely and effectively executed within the legal deadlines.
The Environmental Impact Statement was approved in 2011, with the condition that it would expire if work did not commence within five years. Although the Cabildo de Tenerife argued that work began on August 23, 2016, the judgment indicates that, despite a site layout act, the actions were never actually carried out.

It cannot be admissible for an EIS published in 2011 to remain valid twelve years later simply because actions were carried out on the land for a short period.

This court ruling emphasizes the need for an updated environmental declaration that aligns with new environmental requirements. This is just one of four ongoing procedures related to the Motor Circuit being processed in the TSJC, including appeals from both the Cabildo and ATAN.
The pending second-instance resolutions refer to the Modified Project for the Northern Access to the Tenerife Insular Motor Sports Complex, the Project for Adapting the Tenerife International Motor Park to the Flood Defense Plan, and the Modified Project for the Speed Track at the Tenerife International Motor Park.
ATAN reiterates that the execution of this project not only causes significant environmental damage but also represents a millionaire outlay for the public coffers of the insular Cabildo, amidst a severe environmental crisis on the island.
