The incident, which will be tried this Wednesday at the Audiencia de Las Palmas, involves a driver accused of intentionally pursuing and ramming a motorcyclist. The Prosecution maintains that the driver repeatedly rammed the motorcyclist, endangering both the motorcyclist and the bus passengers.
The events took place on October 18, 2021, around nine in the morning, while the defendant was on duty on line 9 of Guaguas Municipales, covering the route between Hoya de la Plata and Hospital Doctor Negrín. The accusation classifies these acts as crimes of reckless driving and assault with a dangerous instrument.
According to the prosecutor's account, after the initial collisions, the motorcyclist approached the driver to ask for an explanation. In response, the driver, with the intention of disregarding traffic rules and causing physical harm, made an abrupt left turn, invading the opposite lane and cutting off the motorcyclist's path, who was near the left rear tires of the bus.
With his conscious action, he caused the motorcyclist to fall to the ground and become trapped under the bus.
As a result of this event, the motorcyclist suffered severe injuries, including closed thoracic trauma, multiple left rib fractures, bifocal and displaced fractures of the ninth, tenth, and eleventh left costal arches, pulmonary contusion, left scapula fracture, and mild left hydropneumothorax. The injuries required 177 days to heal, in addition to medical assistance, rehabilitation, and various treatments.
The victim was left with permanent sequelae, and his motorcycle sustained material damages expertly valued at 2,947 euros. The Prosecution requests two years in prison for reckless driving and an additional five years for the crime of assault, as well as the deprivation of the right to drive motor vehicles and mopeds for a period of five years. A total compensation of 15,408 euros for the motorcyclist is also sought.
