The athlete, currently playing for CD Tenerife, admitted the events that occurred on May 31st on Antonio Zerolo Herrera street. The sentence, agreed upon by the Court of Instruction number 1 of La Laguna, is final and also convicts two other men who participated in the assault.
According to the judicial account, the three defendants verbally abused a man walking on the public street. After an argument initiated when the victim reprimanded their behavior, a physical assault ensued. Two of the involved parties held the man against a wall while a third kicked him. Subsequently, one of them headbutted him, and the footballer punched him in the jaw. The victim identified himself as a judge to try and stop the assault.
The confrontation continued minutes later near a parking lot. When the victim attempted to record the defendants with his mobile phone while alerting emergency services, he was approached again. Two of them immobilized him, a third snatched his device, and they pushed him down a ramp, causing him to fall. The mobile phone was recovered by the Local Police with damages valued at 135 euros.
As a result of the assault, the judge suffered various bruises and abrasions, as well as anxiety. Medical services determined a basic personal injury of five days without permanent consequences. The judicial resolution emphasizes that the victim was performing his duties at the time of the events.
The three defendants fully admitted the facts and accepted the penalties requested by the Public Prosecutor's Office, benefiting from a legal reduction. The footballer and another of the convicted individuals received eight months in prison and fines for assault and injuries. The third defendant was convicted for the same crimes and for damage to the mobile phone.
The magistrate agreed to suspend the execution of the prison sentences for two years, as the convicted individuals have no prior criminal record and the Public Prosecutor's Office did not object. The suspension will be revoked if any of them re-offend during this period.
