The political group has warned of the legal and financial risks of continuing collection while an appeal is processed before the Supreme Court. According to the data provided, the accumulated revenue amounts to 1,500,000 euros, a sum that might have to be refunded if the court ruling becomes final.
The group's spokesperson announced that a motion will be presented at the upcoming municipal plenary session in July. The proposal includes the creation of a financial contingency plan and a request for a report from the Municipal Comptroller to assess the economic impact of a potential definitive nullity of the regulation.
The organization has questioned the formula used by the local government, arguing that the ordinance creates a tax without the necessary legal coverage. They also highlighted the legal uncertainty this situation creates for the accommodation sector, which could face refund claims from customers.
As an alternative, the group proposes promoting a regional tourist tax, similar to the Galician model, which would allow municipalities to apply surcharges with full legal certainty to fund infrastructure and public services.
