The alleged sexual aggressor, caught in April performing indecent acts on a user at a center managed by the Cabildo in Gran Canaria, had already raised suspicions in March. On that occasion, he was seen in the room of the same victim, a user with autism and severe mental deficiency, making a "strange gesture with his trousers." Concerned employees decided to remain vigilant until April 30th, when they found him in bed with the victim, engaging in sexual touching.
This is detailed in the judicial order that mandated the provisional imprisonment of the investigated individual, who has a criminal record. He is accused of alleged sexual assault against a person unable to consent due to mental incapacity, with the aggravating factor of special vulnerability.
According to a witness's statement, the worker entered the victim's room, where she was alone with another user, and "was performing sexual acts that the victim is unable to consent to." The witness, whose testimony is described as "firm, persistent, and with details apt for corroboration," observed the scene from the hallway and, upon entering, "could perfectly see the alleged aggressor from the side touching" the victim's chest while guiding one of her hands to her genital area.
The judicial resolution highlights that the victim was not assigned to the unit managed by the investigated worker, thus providing no justification for his presence in the room. The magistrate who ordered provisional detention believes there is a risk of flight, of acting against the victim, or of influencing evidence and witnesses, given the potential prison sentence of 5 to 10 years.
