The three Nueva Canarias (NC) councilors in the Santa Lucía de Tirajana City Council, Leví Ramos Sánchez, Yaiza Pérez Álvarez, and Ofelia Alvarado Santana, have welcomed a ruling from the Directorate General of Autonomous and Local Legal Regime, under the Ministry of Territorial Policy. This report supports their position on the political and administrative status of the mayor and the five councilors governing with him, following their expulsion from a party.
In a statement, the NC councilors called for the "immediate restoration of legality in the Santa Lucía de Tirajana City Council." They urged the mayor to "comply not only with the position of the municipal secretary and recent court orders, but also, unequivocally, with the position of the Ministry of Territorial Policy."
Nueva Canarias regrets that the situation had to be confirmed by a ministry of the Spanish Government, which clearly demonstrates, they state, that "the mayor of Santa Lucía de Tirajana has committed an illegality by evading and failing to acknowledge the municipal secretary's report," a report that the Ministry itself considers "good and valid."
The councilors recall that the ministerial report "expressly states that basic local legislation, which applies equally to all city councils in the country, must be interpreted and applied uniformly throughout the national territory." They add that "under no circumstances does it correspond to the Government of Canarias to interpret or regulate state-based legislation," thus invalidating the report from the Canary Islands Vice-Ministry that the mayor used to justify his actions.
The NC representatives have already filed a motion for reconsideration, requesting the mayor to annul "his decision to selectively choose the report from the Canary Islands Vice-Ministry, against current legality and to the detriment of the mandatory report from the municipal secretary." Following the ministerial report's guidance, the three councilors have approached the Government Delegation in the Canary Islands to demand compliance with basic local legislation and for that body to take appropriate measures regarding the "irregular situation that the mayor has deliberately caused."
